DIRECTIVE (EU) 2025/1892 amending Directive 2008/98/EC on waste
On 26 September 2025, DIRECTIVE (EU) 2025/1892 amending Directive 2008/98/EC on waste (Waste Framework Directive) was published in the Official Journal of the European Union. The amendment introduces target provisions to tackle food and textile waste.
The majority of textile toys are out of scope but toy disguise costumes are covered due to their Combined Nomenclature (CN) categorisation of codes 61 and 62, both included in Annex IVc of the Directive.
The Directive applies to a “producer of textile, textile-related or footwear products listed in Annex IVc”. In general, it covers operators within the member states of the EU but it does capture operators based in a Member States / third country selling directly to end-users in another Member State. It also requires that those in a third country (such as the UK) shall appoint an authorised representative.
Producer Responsibility Organisations (PROs) can be used by producers to meet their obligations. Member States shall set criteria regarding PROs and their obligations include: establishing and collecting EPR fees from producers, ensuring that used textiles are collected and managed separately from waste textiles, and to lead communication/awareness campaign for end-users (consumers).
A national register of producers will be established, and producers must submit an application in each member state they place products on the market in. Secondary legislation will be adopted establishing a format for registration.
- EPR schemes need to be established by 17 April 2028 in each member state and will establish related fees.
- Member States shall bring into force the Directive by 17 June 2027 at the latest.
- Producers that are not micro enterprises shall comply from 17 April 2028.
- Micro enterprises shall comply from 17 April 2029.
